Here’s a new twist. Most charter schools start from scratch. If a private school applies to become a charter school and they have debt on the books, who assumes that if they become a charter? Must they retire all debt prior, or does the local LEA assume it? Or will they be allowed to carry debt forward and now use public tax dollars they receive after they go public to pay the previous debt. Just wondering.
Good point, mingo. Here’s what I’d do. Have the original corporation keep the debt and establish the charter as a separate entity. I’m sure the Local Government Commission can give authoritive advice. Maybe the charter can pay some rent to the corporation? I’m not sure how the holders of the debt will feel about this. A potential can of worms, but it should be solvable.
