Local realtor encourages tenants to attend forum


Henderson City Council member and chair of the Community Development Committee Garry Daeke will hold a public forum on the proposed Ordinance Requiring a Permit to Rent Dwelling Units in the City of Henderson.

The forum will take place at Shiloh Baptist Church located at 635 S. College Street in Henderson on Tuesday, September 18, 2007 at 7:00 p.m.

At the Henderson City Council meeting of September 10, 2007, when Daeke originally proposed conducting the forum, he expressed a desire to hear from tenants.

Prim Residential Rentals, Inc. is also encouraging tenants to attend the forum in a flyer distributed to tenants of its rental properties.

The flyer states the belief of the corporation that the Certificate of Occupancy will infringe on constitutional rights because of invasion of privacy rules. It also states that damage accidentally caused by the renter, friends, and family will have to be fixed immediately “or suffer eviction”.

The flyer also says that reinspections will cost the tenant $50 to the City before it reinspects.

In a comment post on Home in Henderson, Daeke wrote that he would “fix” the compromise reached in the ordinance where inspections occur after tenants move into the dwelling.

The original wording of the ordinance called for inspections to take place before tenants moved in. Local landlords successfully argued against the provision, citing the need to fill vacancies quickly so as to not lose revenue on a property and the expense of having utilities turned on so that inspections could take place.

It is unknown if restoring the requirement to have inspections take place before tenants take possession of a rental property will remove constitutional objections.
